Chapter 7 Praise and Incentive
Article 57 The State establishes an honor incentive mechanism for veterans to commend and reward veterans who have made outstanding contributions to socialist modernization. Retired soldiers who receive commendations and rewards during active service shall enjoy corresponding treatment in accordance with relevant national regulations after retirement.
Article 58 The people’s government of the place where the veterans are placed shall hold a reception ceremony when receiving veterans. The welcoming ceremony is carried out by the retired serviceman’s work department of the people’s government of the place of placement.
Article 59 The local people’s government shall hang a glorious card for the families of veterans and regularly carry out visits and condolences.
Article 60 When the state, localities, and military hold major celebrations, representatives of retired military personnel shall be invited to participate.
When invited veterans participate in major celebrations, they can wear the standard clothing at the time of retirement, and wear the medals, medals, commemorative badges and other badges awarded during active service and after retirement.
Article 61 The state attaches importance to the active role of veterans in patriotism education and national defense education activities. Government agencies, group organizations, enterprises, institutions, and social organizations may invite retired soldiers to assist in the development of patriotism education and national defense education. The education administrative department of the people’s government at or above the county level may invite veterans to participate in school national defense education and training, and schools may hire veterans to participate in student military training.
Article 62: The competent departments for the work of veterans of the people’s governments at or above the county level shall strengthen the publicity of the advanced deeds of veterans, and promote the spirit of patriotism, revolutionary heroism and the dedication of veterans through the production of public service advertisements and the creation of themed literary works. Article 63 The agencies responsible for the local chronicles work of the local people’s governments at or above the county level shall edit and record the directories and deeds of the following veterans in their administrative areas into the local chronicles:
(1) Veterans participating in the war;
(2) Retired servicemen who have been awarded second-class merit or above;
(3) Retired soldiers who have been commended at the provincial or ministerial level or above the theater level;
(4) Other qualified veterans.
Article 64 The state makes overall plans for the construction of commemoration facilities for martyrs, and promotes the spirit of heroes and martyrs by organizing and carrying out various commemoration activities for heroes and martyrs. The department responsible for the work of retired soldiers is responsible for the repair, protection and management of the martyrs’ memorial facilities.
The state promotes the construction of military cemeteries. Qualified veterans can be buried in the military cemetery after their death.
Chapter 8 Service Management
Article 65 The state strengthens the establishment of service institutions for veterans and establishes a sound service system for veterans. People’s governments at or above the county level have established service centers for veterans, and service stations for veterans have been set up in towns, sub-districts, rural areas, and urban communities to improve service support for veterans.
Article 66 Service agencies for retired servicemen, such as service centers and service sites for retired servicemen, shall strengthen communication with retired servicemen, and provide services such as support for employment and entrepreneurship, special care and assistance, visits and condolences, and protection of rights and interests for retired servicemen.
Article 67: The competent department for the work of retired soldiers of the people’s government at or above the county level shall strengthen the ideological and political education of veterans, keep abreast of the ideological and working life conditions of veterans in a timely manner, and guide the receiving and placement units and other organizations to do a good job in the ideological and political work of veterans Work and related guarantee work.

Article 68: The competent departments for the work of retired military personnel of the people’s government at or above the county level, the receiving and placement units, and other organizations shall strengthen the confidentiality education and management of the retired military personnel.
Article 69 The competent departments for the work of veterans of the people’s governments at or above the county level shall publicize laws, regulations, policies and systems related to veterans through various channels such as radio, television, newspapers, and the Internet.
Article 70 The competent department for the work of veterans of the people’s government at or above the county level shall establish and improve the protection mechanism for the rights and interests of veterans, unblock channels for expressing their appeals, and provide support and assistance for veterans to safeguard their legitimate rights and interests. The lawful rights and interests of veterans are infringed and should be resolved in accordance with the law. Relevant public legal service agencies shall provide legal aid and other necessary assistance to veterans in accordance with the law.
Article 71: The competent department for the work of retired military personnel of the people’s government at or above the county level shall instruct and urge relevant departments and units in accordance with the law to do a good job in decommissioning placement, education and training, employment and entrepreneurship, pensions and preferential treatment, praise and incentives, support for military superiors, etc., and supervise and inspect the protection of veterans. The implementation of relevant laws, regulations and policies and measures, and promote the resolution of problems in the protection of veterans.
Article 72 The State implements a responsibility system and an assessment and evaluation system for veterans’ support work. The people’s governments at or above the county level shall include the completion of the security work for veterans into the assessment and evaluation of the departments and their responsible persons of the people’s governments at the same level that are responsible for the work of veterans, and the lower-level people’s governments and their responsible persons.
For regions and units where the security policies for veterans are not fully implemented and the work is not well advanced, the veterans work department of the people’s government at or above the provincial level will meet with the relevant departments to discuss the main person in charge of the people’s government in the area or the main person in charge of the unit.
Article 73 The competent department for the work of veterans and their staff shall consciously accept social supervision when performing their duties.
Article 74: Relevant agencies and departments shall handle reports and accusations of violations of this Law in the protection of veterans in a timely manner in accordance with the law, and inform the informants and accusers of the results.
Chapter 9 Legal Liability
Article 75: Where the competent department for the work of retired soldiers and their staff commit one of the following acts, their superior competent department shall order corrections, and the directly in charge and other directly responsible personnel shall be punished according to law:
(1) Failure to determine the remuneration of retired soldiers in accordance with regulations;
(2) Issuing false documents in the placement of veterans;
(3) Issuing veterans preferential treatment certificates to those who do not meet the requirements;
(4) Misappropriating, withholding, or privately dividing the security work funds for retired soldiers;
(5) Violating the regulations to determine the objects, standards, and amounts of pension benefits, or granting retired soldiers relevant treatment;
(6) Taking advantage of their position to seek personal gains for themselves or others in the protection of veterans;
(7) Dereliction of duty in the protection of veterans;
(8) Other violations of laws and regulations.
Article 76: Where other departments and their staff in charge of related work for veterans violate the relevant provisions of this Law, their superior competent department shall order corrections, and the directly in charge and other directly responsible personnel shall be punished according to law.
Article 77 In violation of the provisions of this law, refusing or unreasonably delaying the implementation of retired military personnel’s tasks shall be ordered by the retired military personnel work department of the people’s government of the place of placement to make corrections within a time limit; those who fail to make corrections within the time limit shall be notified and criticized. The principal and directly responsible persons of the unit shall be punished by relevant departments according to law.
Article 78 Where a retired soldier resorts to fraud and deception to obtain retirement-related benefits, the relevant remuneration shall be cancelled by the veteran’s work department of the local people’s government at or above the county level, the illegal gains shall be recovered, and the unit to which he belongs or the relevant department shall impose sanctions in accordance with law.
Article 79 Where a veteran violates the law and commits a crime, the veteran work department of the provincial people’s government shall suspend, reduce or cancel his retirement-related benefits in accordance with relevant state regulations, and report to the State Council’s veteran work department for the record.
Retired military personnel who disagree with the decision of the provincial people’s government to suspend, reduce or cancel their retirement-related benefits may apply for administrative reconsideration or file an administrative lawsuit in accordance with the law.
Article 80 Anyone who violates the provisions of this law and constitutes a violation of public security management shall be given public security management penalties according to law; if a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter X Supplementary Provisions
Article 81 This Law shall apply to police officers, policemen, and conscripts of the Chinese People’s Armed Police Force who have retired from active service in accordance with the law.
Article 82 The provisions of this Law concerning military officers shall apply to civilian cadres.
Where military academies and academies have retired from active service according to law, the relevant provisions of this law shall be referred to.
Article 83 Retired servicemen participating in the test shall be implemented in accordance with the provisions of this Law concerning retired servicemen participating in the war.
The scope, certification standards, and procedures for participating veterans and test veterans shall be stipulated by the relevant departments of the Central Military Commission in conjunction with the department in charge of veterans work under the State Council.
Article 84. After the officers resign and recuperate and the officers at or above the military level retire, they shall be placed and managed in accordance with the relevant regulations of the State Council and the Central Military Commission.
The treatment guarantee for veterans who have been placed in an independent job selection method before the implementation of this law shall be implemented in accordance with the relevant regulations of the State Council and the Central Military Commission.
